Preliminary Resolution Declaring Intent to
Exercise Special Assessments Under Municipal Police Powers Pursuant to Section 66.0701 Wisconsin Statutes and Village Code of Ordinances for the Costs of Sidewalks and Storm Laterals in the
Village of Suamico, Brown County, Wisconsin
RESOLVED, by the Suamico Village Board, Village of Suamico, Brown County, Wisconsin:
1. The Village Board hereby declares its intention to exercise its police power under
Section 66.0701, Wisconsin Statutes and Village Code of Ordinances, to levy special assessments upon property within the following described Assessment District within the Village of Suamico for special benefits conferred upon such property by the installation of sidewalks and storm laterals as hereinafter described.
2. The property to be assessed lies within the following described assessment district:
ASSESSMENT DISTRICT AREA
The assessment District identified as Birch Road Reconstruction:
Parcel SU 521-4, SU 521-3, SU 521-2, SU 521-1, SU 936-501,
SU 936-502
3. The Village shall cause sidewalks and storm laterals to be constructed adjacent to and serving each lot fronting on such street and shall keep an accurate account of the expenses incurred collectively in front of each lot and shall report these costs to the municipal clerk who shall cause the amount charged to each lot to be entered on the tax roll as a special tax against the lot unless payment is made in full for the assessment amount. The assessment against any parcel may be paid in cash or installments to be determined at the public hearing on the proposed assessment.
4. The total amount assessed against the property located in the Assessment District
shall not exceed 100% of the Village’s direct and indirect costs for said sidewalks and storm laterals, including but not limited to:
Actual construction costs, related costs and expenses of engineering and legal services, administration and borrowing.
5. The Village Board determines that the improvements constitute an exercise of its police powers for the health, safety and general welfare of the municipality and its inhabitants.
6. The Village engineer shall prepare a report consisting of:
Final plans and specifications for said improvements
;An estimate of the entire direct and indirect costs and expenses of the completed work for improvements as described in Paragraph 4 of this Resolution;
A schedule of the proposed assessments.
A statement that the respective properties against which the final assessments are proposed are benefited.
7. A copy of the report has been filed with the Village Clerk for public inspection.
8. Upon filing of the engineer’s report the Village Clerk caused notice to be given stating the nature of the proposed improvements, the general boundary lines of the proposed Assessment District, (including a small map thereof,) the place and time at which the report may be inspected, and the place and the time and place of the public hearing on the matters contained in the preliminary resolution and the report. This notice was published as a class 1 notice under ch. 985, Stats, and a copy of the Notice mailed to every interested person whose post office address is known, or can be ascertained within reasonable diligence, at least ten (10) days before the hearing. The hearing shall commence not less than ten (10) days and not more than forty (40) days after publication of the class 1 notice.
9. The hearing shall be held in the Village of Suamico, Village Hall at the following address: 2999 Lakeview Drive, Suamico, Wisconsin at 7 P.M. on Monday, May 5, 2008 in accordance with 66.0701 Wisconsin Statutes and Village Code of Ordinances.
10. The assessment against any parcel may be paid in cash or in installments the number of which shall be determined at the public hearing on the proposed assessments.
