WHEREAS, The Village of Suamico has received a petition to vacate the plat of Rabbit Ridge including all lands having been dedicated to the public, being part of the southwest ¼ of the southwest ¼ and part of the southeast ¼ of the southwest ¼ of section 7, T25N-R20E, Village of Suamico, Brown County, Wisconsin; and

WHEREAS, The Village of Suamico shall retain possession of those lands dedicated to the public being part of the southwest ¼ of the southwest ¼ section 7, T25N-R20E, Village of Suamico, Brown County, Wisconsin; as identified on Exhibit "A" of this document, and

WHEREAS, The Village of Suamico shall retain possession of those lands dedicated as utility easement being line adjacent to Pitco Road and School Lane (C.T.H. B) Right-of-way being part of said subdivision; as identified on Exhibit "A" of this document, and

WHEREAS, All lands having been dedicated to the public prior to the recording of the plat of said subdivision; shall remain dedicated to the public, and

WHEREAS, The Village Board has notified the adjoining property owners pursuant to Wisconsin Statute 236.43 of the petition to vacate a portion of lands dedicated to the public as part of the plat of said subdivision, and

WHEREAS, The Village Board held the requisite Public Hearing on the petition to vacate a portion of lands dedicated to the public as part of the plat of said subdivision; and

WHEREAS, After receiving public input the Village Board believes that it is in the public interest of the Village of Suamico to vacate a portion of lands dedicated to the public as part of the plat of said subdivision.

NOW, THEREFORE, BE IT RESOLVED that the Village Board declares that the portion of lands dedicated to the public as part of the plat of Rabbit Ridge being part of the southwest ¼ of the southwest ¼ and part of the southeast ¼ of the southwest ¼ of section 7, T25N-R20E, Village of Suamico, Brown County, Wisconsin; be vacated effective upon plat vacation of said subdivision by the circuit court.

BE IT FUTHER RESOLVED, that the Village of Suamico supports the petition, by the owners of said subdivision, to the circuit court for vacation of the plat of said subdivision; and

BE IT FUTHER RESOLVED, that the Administrator and or the Community Development Director are duly authorized to apply to the circuit court to vacate a portion of lands dedicated to the public as part of the plat of said subdivision.
