Establishing a Policy Providing for Procedures for the Enforcement of Code Violation Complaints
WHEREAS, the Village of Suamico observes obvious violations, receives many calls or letters of complaints which allege a violation to certain village codes; and
WHEREAS, these complaints may vary in nature and relate to a variety of different codes; and
WHEREAS, the Village Board desires that the Village staff respond uniformly when staff observes an obvious violation, receives a legitimate complaint or is given direction from the majority of the Village Board at a regularly scheduled meeting; and
WHEREAS, the Suamico Village Board recognizes a citizen’s right to privacy and the right to be protected from undue governmental interference.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Village Board of the Village of Suamico that the following procedures be followed in the enforcement of code violation complaints:
Code Enforcement
On an as-needed basis or if a complaint has been received by Village staff, staff will investigate code violation complaints to determine if the alleged violations exist.
A complaint shall include the following information:
Name of person submitting complaint.
Name and/or address of property being complained about.
Specific nature of complaint including date, time, and
nature of alleged violation.
2. Enforcement Measures
A. Upon review of the complaint, should the Village staff determine that there is probable cause to investigate the complaint the Village staff shall physically inspect the property in question.
B. Should the Village staff determine that a violation does exist a written notification shall be sent to the property owner of the property where the violation is.
Said notification shall include a description of the violation, the sections of the Village code which have been violated and the recommended action required to abate the violation.
C. The property owner shall be given ten (10) days or such other reasonable amount of time as the staff determines necessary, to abate said violation.
The staff shall re-inspect the property at the termination of time given to abate the violation. Upon re-inspection by Village staff if said violation has not been corrected a code violation citation shall be issued to the property owner.
If said violation is not abated in accordance with the requirements of the notification and after issuance of a citation, staff will schedule action by the Village Board to direct staff to obtain a court order for the abatement of said violations. The state statute procedures established for obtaining such court orders shall be followed.
3. Privacy
A. Persons requesting anonymity will be protected to the extent possible under Wisconsin law.
