FINAL RESOLUTION AUTHORIZING PUBLIC IMPROVEMENT AND LEVYING SPECIAL ASSESSMENTS AGAINST BENEFITED PROPERTY along Riverside Drive, Lakeview Drive Transmission Water Main in SUAMICO, WISCONSIN

 

WHEREAS, the Suamico Village Board, held a public hearing at the Village Hall, 2999 Lakeview Drive at 7 p.m. on the 17th of April 2006, for the purpose of hearing all interested persons concerning the preliminary resolution and report of the village engineer on the proposed public improvements consisting of the installation of water utilities and preliminary assessments against benefited property, and heard all persons who desired to speak at the hearing;

NOW THEREFORE, BE IT RESOLVED, the Suamico Village Board determines as follows:

1. The final assessment schedule, a copy of which is attached hereto and incorporated herein as if fully set forth herein, including the plans and specifications and assessments set forth therein, is adopted and approved.

2. The village board advertised for bids and supervised construction of the improvements in accordance with the modified report hereby adopted.

3. Payment for the improvements shall be made by assessing 100% of the cost of the water mains and all appurtenances to the property benefited as indicated in the report.

4. Benefits shown on the report as modified are true and correct and are hereby confirmed.

5. Assessments for all projects included in the report are hereby combined as a single assessment, but any interested property owner may object to each assessment separately or all assessments jointly for any purpose.

6. Assessments shall be due within 45 days of billing date. Assessments may be paid in cash or in annual installments to the Municipal Treasurer according to section 8 of the Village of Suamico Comprehensive Assessment Policy. Installments shall be placed on the next tax roll after the due date for collection and shall bear interest at the rate of 6.40% per annum on the unpaid balance from the adopted date of this resolution. Installments or assessments not paid when due shall bear additional interest on the amount due at the rate of 6.40% per annum beginning from the adopted date of this resolution.

7. The Municipal Clerk shall publish this resolution as a Class 1 Notice under Chapter 985, Stats., in the Assessment District and mail a copy of this resolution and a statement of the final assessment against the benefited property together with notice of installment payment privileges to every property owner whose name appears on the assessment roll whose post office address is known or can with reasonable diligence be ascertained.

8. In accordance with the Village of Suamico special assessment procedures ordinance 2005-22, Section 6, "Any person against whose land a special assessment is levied pursuant to this Resolution may appeal in the manner prescribed in Section 66.0703(12) Wis. Stats. within 40 days of the date of this Resolution."
