4) Public forum
It was brought to the attention of staff the condition of the culverts on Elvira Way & Ancestor Way & the culvert on Northwood Road just north of Whippoorwill Road.
Staff reported that these items will be fixed within 3 weeks of the natural thaw.
5) Approve minutes: January 22nd, 2008
Motion to approve the minutes with the changes as discussed was made by Dan Behm; second by Matt Athey.

6) Discussion Regarding Drainage Issues on SU-784 Owned by Farrell
STAFF/ENGINEER’S REPORT (REVIEW DRAINAGE ON THE PARCEL THAT IS ON THE NORTHWEST CORNER OF LINEVILLE ROAD):
The Farrell family owns a parcel of land located on the west side of West Deerfield. This parcel is immediately north of Lineville Road. According to the petitioners this parcel has been in the Farrell family for more than 100 years and was used for agricultural purposes prior to the relocation and construction of Highway 41. Since that time, the area has either converted to or reverted back to wetlands. The Farrell’s claims that revisions to the culvert system and cleaning of ditches between this parcel and the waters of Green Bay would help remove waters from their property.
It appears at one time that the Town of Suamico and the Brown County Highway Department had agreed to make revisions to this drainage basin, and that those plans were abandoned due to correspondence from the Department of Natural Resources dated November 19th, 1999 indicating that revisions to this drainage area would not be approved by the department.
Engineering staff did verify grades on existing culvert pipes in the area. (Commission members were given a copy of the grades for their review.)
The pipe under the Highway 41 northbound off ramp is sloping in the wrong direction. The village has no authority to make revisions to this structure.
The pipe under West Deerfield is slightly higher than the pipe under Lineville Road and a foot above the downstream pipe.
After reviewing the data it does indicate that there could be a potential to lower the water elevation in this area by about 0.5’ by adjusting the flow line of the West Deerfield cross pipe.
Village staff does not believe that this alteration would have any affect on the wetlands classification on this parcel.
It has been indicated to the Farrell family that before the Village of Suamico would even consider making revisions to any of these drainage structures that the village would want a letter of concurrence from the DNR.
COMMISSION:
It is clear by the notes the commission received that the town had approved to go and do the work and the county wanted to do it; somehow it got stopped.
The town and county voted yes and it is in the record and yet it was never done.
We should look into why this was never done and we need to find out if the county still wants to do it.
Motion was made by Matt Athey to recommend that staff discuss the options with the County, State, DOT, DNR and the Army Corp of Engineers to get more information and bring it back for an update, and for village staff to participate in the meetings with the county; second by George Smith.

7) Discussion Regarding Replacement of Driveway Culvert Pipes During Reconstruction Projects and or Due to Failure.
STAFF/ENGINEER’S REPORT
Staff is looking for input from the commission on where we want to go when the village does road reconstruction in regards to culvert pipes. When the village is doing a major reconstruct, at times we’re putting ditches in where there are no ditches and sometimes we’re doing a pulverizing and resurfacing. The question does arise in regards to the private driveway culvert pipes, is it the responsibility of the village to supply a new culvert pipe to the homeowner?
As these roads are rebuilt, staff is looking for direction from the commission members on the policy/procedure that should be followed.
Motion was made by Paul Garvey that replacement of driveway culvert pipes that a part of the municipal reconstruction projects that the costs be borne by the project and the other culverts which need to be replaced be paid for by the property owners with the installation conducted by the village if they are there working. (For clarification, these would be just the culverts that are in poor condition.); second by Mark Salmon.
