MINUTES

Call Meeting To Order

Chair Sheedy called the meeting to order at 7:00 PM

Commission members present: Chair Sheedy, Commissioner Salemi, Commissioner Zastrow, Commissioner Thomson, Commissioner Robb.

Commission Members absent: Commissioner Wagner and Commissioner Magray

Staff present: Steve Dunks, Zoning Administrator, Graham Callis, Community Development Director, and Abby Villars, Deputy Clerk

Approve Agenda

Motion by Commissioner Robb to approve the agenda as submitted.

Second by Commissioner Zastrow.

Motion carried 5-0.

Consent agenda

a. Approve the Minutes of the Wednesday, April 9, 2008, Planning & Zoning Commission Meeting

b. Building Permit Report: March 2008

Motion by Commissioner Salemi to approve as submitted.

Second by Commissioner Thomson.

Motion carried 5-0

Public Forum (non-agenda items): Anything, which may be brought before the Plan Commission, for which no referral shall be made or action shall be taken.

No one spoke.

Discussion/Recommendation: Request by Patrick McQuillin, 4292 Lakeview Drive, parcel SU-194, located on the east side of Lakeview Drive approximately ¼ south of Norfield Road for;

c. A one lot certified survey map (CSM)

d. Rezone the portion described in the CSM from Agriculture to Rural Residential

Jim Rienow 3212 N Lakeview Drive- Spoke in regards to the driveway on the property.

A one lot certified survey map (CSM)

Motion by Commissioner Salemi to recommend approval of the one lot certified survey map.

i. The area shown as Lot 1 is rezoned from Agriculture to Rural Residential

ii. Verification and designation of all wetlands and ESAs by Brown County Planning

iii. Addition of a note that shall read as follows: "A shoreland permit from the Village of Suamico Zoning Administrator is required prior to any construction, fill or grading activity within 300 feet of a stream.

iv. Addition of a restrictive covenant that shall read as follows: "The property owners, at the time of construction, shall implement the appropriate soil erosion control methods outlined in "Wisconsin Construction Site Best Management Practice Handbook" to prevent soil erosion. However, if at the time of construction the Village of Suamico has adopted a soil erosion control ordinance, it shall govern over this requirement. This provision applies to construction or related activities that may cause soil erosion by that action.

v. Change the building setback line from 40 feet to 45 feet.

vi. Label lands being dedicated to the public as "dedicated to the public" or "DTTP"

vii. Addition of tax parcel ID numbers for all surrounding parcels.

viii. Appropriately label all surrounding platted and unplatted lands

ix. Show all existing driveways and access points for Lot 1

x. Meets requirements of all other applicable ordinances, regulations, and reviewing agencies.

Second by Commissioner Zastrow

Motion carried 5-0.

Rezone the portion described in the CSM from Agriculture to Rural Residential

Motion by Commissioner Salemi to recommend approval to rezone the portion of SU-194 as described in the certified survey map from Agriculture to Rural Residential.

Second by Commissioner Zastrow.

Motion carried 5-0.

Discussion/Recommendation: Request by James (Louis & Darlene) Kriescher, 2236 Jesse Lane, parcel SU-752-7, located on the east side at the southern end of Jessie Lane for a Conditional Use permit for a horse. Zoned Rural Residential.

James Kriescher 2236 Jesse Lane- Was available for questions.

Motion by Commissioner Thomson to recommend approval of a conditional use permit for a horse on property SU-752-7, 2236 Jesse Lane, with the following conditions:

xi. The horse shall be contained to the parcel. Any use outside of the proved parcel shall be with the land owners’ permission only

xii. All waste shall be contained and disposed of in a manner that will not create unsightly views or objectionable odors

xiii. The Village reserves the right to review the Conditional Use permit for violations of the conditions of approval and rescind if necessary

Second by Commissioner Robb.

Motion carried 5-0.

Discussion/Recommendation: Town center overlay plan, generally located east & west of US HWY 41 and north & south of CTY HWY B.

Motion by Commissioner Thomson to recommend approval of the Town Center overlay plan.

Second by Commissioner Salemi.

Motion carried 5-0.

Discussion/Recommendation: Changes to Chapter 18 regarding swimming pools, decks & gazebos and how they affect accessory structure counts & setbacks.

Motion by Commissioner Zastrow to recommend approval to the changes to Chapter 18 regarding swimming pools, decks & gazebos and how they affect accessory structure counts & setbacks.

Second by Commissioner Salemi

Motion carried 5-0.
