An Ordinance Creating Section 12.10 of the Municipal Code Authorizing Neighborhood Electrical Vehicles
The Village Board of The Village of Suamico, Wisconsin Does Ordain as Follows:
Ordinance Section 1:
12.10 Neighborhood Electric Vehicles
Definition: Neighborhood Electric Vehicle (NEV) means a self-propelled motor vehicle that has successfully completed the neighborhood electric vehicle America test program conducted by the Federal Department of Energy, and that conforms to the definition and requirements for low-speed vehicles under 40CFR 571.3(b) and 571.500 and which is authorized under Wis. Stats. §349.26.
Use allowed
1. Subject to the requirements set forth herein, Neighborhood Electric Vehicles may be operated on roadways within the Village which have a maximum speed limit of 35 mph or less and designated Brown County roadways or portions thereof with speeds of 35 mph.
i. Requests for designated roadways shall be made to the Village Health & Safety Committee. The committee shall take into account traffic load and other safety considerations when deciding whether to designate a roadway or portion thereof as safe for NEVs.
ii. The decision of the Health & safety Committee shall be final.
2. All operators of NEVs shall conform to all regulations contained in this Chapter, including the provisions of state motor vehicle laws incorporated herein, except those provisions which by their express terms have no application to a NEV.
3. All operators of NEV shall have a current and valid drivers license issued by the state of their domicile.
4. No NEV may be operated on roadways within the Village which have a posted speed over 35 mph.
Penalties
Any person who violates any provision of this Chapter shall be punished by forfeiture not to exceed $1,000 per occurrence.
Ordinance Section 2: All ordinances or parts of ordinances inconsistent with or contravening the provisions of this ordinance are hereby repealed.
Ordinance Section 3: This ordinance shall be in full force and effect following passage and publication.
