Ordinance 2008-01

AN ORDINANCE ADOPTING AND ESTABLISHING A NEW CODE OF ORDINANCES FOR THE VILLAGE OF SUAMICO; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THERE IN, EXCEPT AS HEREIN EXPRESSLY PROVIDED; PROVIDING FOR A PENALTY FOR THE VIOLATION THEREOF; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE

The village board of the Village of Suamico do ordain as follows:

ORDINANCE SECTION 1. - This Code of Ordinances (Code) is hereby adopted and enacted as the Code of Ordinances for the Village of Suamico, Wisconsin and shall be treated and considered as a new and original comprehensive ordinance which shall supercede all other general and permanent ordinances of the village passed on or before January 31, 2008 to the extent provided in section 2.

ORDINANCE SECTION 2. – All provisions of this code shall be in full force and effect after February 1, 2008 and all ordinances of a general and permanent nature of the Village of Suamico (Village) enacted prior to February 1, 2008, and not included in the Code and continued in force by reference are hereby repealed from the Code after February 1, 2008. No Ordinance of the Village not specifically mentioned is repealed.

ORDINANCE SECTION 3. - The repeal provided for in section 2 shall not affect the following, except that some of the following provisions existed at the time of adoption and may be amended by this recodification:

Any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before the effective date of this ordinance.

Any ordinance promising or guaranteeing the payment of money for the Village.

Any contract or obligation assumed by the Village.

The administrative ordinances of the Village not in conflict or inconsistent with the provisions of this Code.

Any appropriation ordinance.

Any right or franchise granted by the Village Board to any person, firm, or corporation.

Any ordinance naming, establishing, locating, relocating, opening, closing, paving, widening, vacating, etc. any public street or way in the Village.

Any ordinance establishing the street grades of any street in the Village.

Any ordinance providing for local improvements or assessing taxes or special assessments.

Any ordinance dedicating or accepting any plat or subdivision in the Village.

Any ordinance annexing property to the Village.

Any ordinance regulating the erection, alteration, repair, demolition, moving or removal of buildings or other structures, except as these ordinances have been amended as part of this recodification.

Charter ordinances

The issuance of corporate bonds and notes of the Village of whatever name or description.

Water and sewer rates, rules, regulations and sewer and water main construction.

The repeal shall not be construed to revive any ordinance or part of an ordinance that has been repealed by a subsequent ordinance, which is repealed by this ordinance.

ORDINANCE SECTION 4. – A copy of the Code shall be kept on file in the office of the Village Clerk, preserved in loose leaf form or in such other form as the Clerk considers to be expedient. It shall be the duty of the Clerk or the Clerk’s designee to insert in their designated places all amendments and ordinances which indicate the intention of the Village Board to make the same a part of the Code and to extract from the Code all provisions which may be repealed from time to time by the Village Board. A copy of the Code shall be available for all persons desiring to examine it. Copies of the code shall be produced at the regular copy rate as established from time to time by resolution of the village board.

ORDINANCE SECTION 5. - All ordinances or parts in conflict herewith are, to the extent of such conflict, hereby repealed.

ORDINANCE SECTION 6. - Recodification of the Code of Ordinances is being accomplished pursuant to the provisions of Wis. Stat. §66.0103.

ORDINANCE SECTION 7. - This ordinance shall take effect and be in full force from and after its date of passage.
