An Ordinance Amending Chapter 7 of the village code, NEWSPAPER BOXes/MAILBOXes/DRIVEWAYs
The Village Board of The Village of Suamico, Wisconsin Does Ordain as Follows:
Ordinance Section 1: Village of Suamico Village Code, Chapter 7- Newspaper Box/Driveway Ordinance is repealed in its entirety.
Ordinance Section 2: Village of Suamico Village Code, Chapter 7- Newspaper Boxes/Mailboxes/Driveways is created to read per the attached.
Ordinance Section 3: All ordinances or parts of ordinances inconsistent with or contravening the provisions of this ordinance are hereby repealed.
Ordinance Section 4: This ordinance shall be in full force and effect following passage and publication.

CHAPTER 7
NEWSPAPER BOXES/MAILBOXES/Driveways
7.01 NEWSPAPER BOX/MAIL BOX PLACEMENT.
MAILBOXES: No support for a mailbox shall be located on the pavement or gravel shoulder of the roadway or within 2 feet of the pavement when there is no shoulder.
a. Mailbox supports shall be placed such that the face of the mailbox is not more than 18 inches nor less than 6 inches behind the edge of the pavement or back of curb.
b. The bottom of the mail box shall be no greater than 42 inches nor less than 38 inches above the traveled pavement surface of the road.
c. The use of supports such as heavy metal posts, concrete posts, misc. items of farm equipment, and milk cans filled with concrete, is prohibited and considered a detriment to public safety.
NEWSPAPER BOXES: All newspaper boxes within the Village limits shall henceforth be attached, or placed as close as practical to, residential and commercial mailboxes specified and utilized by the United States Postal Service. It is intended by this section that:
d. mailboxes shall be attached to the pole and/or other edifice utilized for placement of the United States Postal Service mailboxes.
e. no newspaper boxes shall exist or be placed on the side of Village Roads alternate from the side whereon United States Postal Service mailboxes are placed.
7.02 DRIVEWAYS.
No driveway shall be constructed in the Village of Suamico unless a driveway permit is first obtained for said construction by the Building Inspector. The driveway permit shall be obtained by the contractor or person performing the work with respect to any driveway. The fee for said driveway permit shall be as adopted from time to time by resolution of the Village Board.
No driveway shall exceed the following width at the right of way in an area having curb & gutter or at the point directly over the culvert or flowline in an area having ditches. Tapers and radii implemented to match the road edge shall conform to the details supplied at the time application is made.
Single Family Residential. Not less than twelve feet (12) nor more than twenty four feet (24)
Duplex Shall be considered as two single family residential units with no consideration for additional width. Two or more contiguous width driveways will not be considered.
Nonresidential Uses
(1) One-way Driveway. Not less than twelve feet (12') wide or more than twenty two feet (24') wide.
(2) Two-way driveway serving twenty (20) or fewer parking spaces or one loading berth. Not less than twenty two feet (22') wide or more than twenty five feet (25') wide for a.
(3) Two-way driveway (2 lanes out and 1 lane in) without a median. Not less than twenty four feet (24') wide or more than thirty eight feet (38') wide.
(4) Two-way driveway (2 lanes out and 1 lane in) with a median, serving more than twenty (20) parking spaces or two (2) or more loading berths. Not less than twenty four feet (24') wide or more than forty four feet (44') wide.
Planned Commercial Developments (PCD) shall comply with the special consideration received under the direction of the Planning Commission and Village Board.
Corner Lots.
On a corner lot, no driveway shall be closer than thirty (30) feet to the point of curvature or 42’ from the two intersecting property lines on all local streets.
On a corner lot, no driveway shall be closer than fifty (50) feet to the point of curvature or 62’ from the intersection of the two intersecting property lines on all collector streets.
In areas where there is not curb and gutter, CONCRETE DRIVEWAYS WILL NOT BE ALLOWED ON THE VILLAGE RIGHT-OF -WAY. In areas where there is not curb and gutter, the property owner may install a concrete driveway, but only up to the Village right of way. The property owner shall install only blacktop from the street through the Village right-of-way.
Where curb and gutter is present with or without storm sewer, concrete driveways shall be constructed. Where a culvert is required, reinforcement will be utilized within the right of way to minimize heaving and cracking.
Where a culvert is required by the Department of Public Works on a Village street, the minimum size shall be fifteen (15) inches. The Director of Public Works or Village Engineer may grant twelve (12) inch culvert under special consideration.
a. All culverts must conform to Village approved engineered ditch grades.
b. If alteration is deemed necessary by the Village, it shall be done at the owner’s expense.
c. On a Brown County road located within the Village limits, the minimum culvert size shall be eighteen (18) inches. A Brown County driveway permit is required.
7.03 PENALTY.
Village residents shall comply with the provisions herein and shall be subject to forfeiture not less than $20 nor more than $2,500 for each violation. Each day a violation exists shall be considered a separate offense. In addition, the owner or occupant shall be responsible for the costs of prosecution and in default of payment of such forfeiture and costs; he/she may be imprisoned in the County Jail until said forfeiture and costs are paid, but not to exceed thirty (30) days for each violation.
